This Reponse Is To Lashunda Harvey's Question In Reference To Getting Rid Of A Misdm Charge Off A Criminal Record. Lashanda, Get Yourself A North Carolina General Statue Book And Look Up (General Statue 15A-145) Or (General Statue 15A-146) These Two Statues Gives You Step By Step Instructions On How To Expunge A Misdm Charge. Check The Library For The Book Or Try To Google "G.S. 15A-145 Or G.S.15A-146" Good Luck!

My mother is a child support agent, so I have some knowledge of how things typically work. First of all, the extra money that he spends on the child doesn't help him out in the eyes of the court. It's considered just that, "extra". Instead of spending and/or giving extra money, I would recommend that he put it towards his past due support. If the child needs a pair of shoes then he should pay whatever amount he would contribute towards them directly on his child support account. Then the mother can buy the shoes for the child "from" Dad.

People that are behind in court ordered child support and currently paying are typically eligible for an arrearage payment plan. (For example: If the past due amount is $1,000 and his current order is 300.00 per month, he might be able to get a plan to pay that amount plus an extra 20 or 30 dollars monthly on the past due.)

If he and the mother both agree to term the support she will need to write a letter (notarized) to her child support agent requesting the case be closed. She can also do the same regarding the past due child support. He will then only owe any past due public assistance that the mother may have received, if any.

Greetings....I have friend who is tied up with child support. The child is now 18 years old. The mother has been to court with the father in front of a judge to ask for child support to be dropped. The mother is in agreement with dropping child support. However, the DA suggested he continue to pay child support because the child is still in school (last year). He is behind a small amt. and he has ben behind before with a smaller amt. Now the bank has put a freeze on his account. He has a meeting with his social worker and has to go back to court in front of a judge. He has been paying child support and doing other things with the child (spending extra money). He feels as if he is being pushed up against the wall. Any suggestions or ideas of what he should do at this point. Thanks.

Hi.. I have a friend that is wishing to have a criminal offense that happened over 12 years ago removed from their record. It is a Class 3 Misdm. and no other offenses have been commited since then. Can you offer any advice on how this could be removed?? Thanks...

Alfie, if you could contact his attorney who represented him on those charges and speak with him in regards to filing a motion for appropriate relief. This is a post-conviction matter.

Is it possible to get a MAR for a mental health consumer that was convicted of Armed Robbery when he was a teen. He did about 5 or 7 years in NCDOC. Of course Durham County...... No other trouble...
